Terms of Service - Evelant

1. Agreement to Terms

By accessing or using the Evelant browser extension and web application (the "Service"), you agree to be bound by these Terms of Service. If you disagree with any part of the terms, you may not access the Service.

2. Description of Service

Evelant provides an AI-powered assistant through a browser extension and associated web dashboard. We connect your inputs and browser context to third-party Large Language Models (LLMs) to generate responses and perform tasks.

3. Acceptable Use

You agree not to use the Service:

In any way that violates applicable local or international laws and regulations.
To transmit or generate harmful, illegal, abusive, or explicitly offensive content.
To attempt to bypass, exploit, or reverse-engineer the API limits or the Service's security mechanisms.
For automated programmatic usage (e.g., scraping, bots) without explicit authorization via our provided API endpoints.
To resell, sublicense, or provide unauthorized access to the Service or its outputs at scale.

4. Subscriptions & Billing

Evelant Pro is a recurring subscription billed through LemonSqueezy. Subscriptions auto-renew at the end of each billing period unless canceled before renewal.

You may cancel anytime from your dashboard under Settings → Billing, which opens the LemonSqueezy Customer Portal to manage or cancel your subscription.

Price changes will be communicated in advance. Continued use after a price change constitutes acceptance of the new price.

5. Refund Policy

We want you to be satisfied with Evelant. If you subscribed to a paid plan and are not happy with the service, you may request a full refund under the following conditions:

The refund request is made within 7 days of the initial charge for that billing period.
You have sent fewer than 50 messages during that billing period.
This is your first refund request for the account.

Refunds are not available for renewal charges after the first billing period, for annual plans after 7 days, or if the usage limits above have been exceeded.

To request a refund, email [email protected] with the subject line "Refund Request" and include the email address used at checkout. Approved refunds are processed through LemonSqueezy and typically appear within 5–10 business days.

6. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of Evelant and its licensors. The generated output produced by the AI models based on your prompts belongs to you, subject to the terms of the respective underlying AI providers.

7. Disclaimer of Warranties

Evelant is provided on an "AS IS" and "AS AVAILABLE" basis. We make no representations or warranties of any kind, express or implied, regarding the accuracy, reliability, or availability of the Service or the AI-generated responses. You are solely responsible for evaluating the accuracy of any output generated by the Service.

8. Limitation of Liability

In no event shall Evelant, nor its developers, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.

9. Account Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

10. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will try to provide at least 30 days notice prior to any new terms taking effect.

11. Service Availability & Changes

We continuously improve the Service. Features may be added, changed, or removed over time, and we will provide reasonable notice of material changes where practical. We strive to maintain high availability but do not guarantee uninterrupted access. We may collect aggregated, non-identifying usage metrics to improve the product, in line with our Privacy Policy.
